Hayley has over 20 years’ experience as a Chartered Legal Executive. She joined Oglethorpe Sturton & Gillibrand solicitors Private Client Department as a Student Member of CILEX in 2001, becoming an Associated Member in 2005 and qualifying as a Fellow of CILEX 2007.

Specialist areas that Hayley covers include:

Wills, estate planning and Lasting Powers of Attorney including the drafting of straightforward and complex Wills including trust structures as well as estate planning with consideration given to inheritance and capital gains tax. Lasting Powers of Attorney for business and personal matters and registration of Enduring Powers of Attorney.

Administration of estates both testate and intestate, calculation of inheritance tax and claims for relief, negotiation with HM Revenue and Customs. Applications for various Grants of Probate including Administration Ad Colligenda Bona, Administration De Bonis Non and Double Probate. Advising on and drafting Deeds of Variation for beneficiaries.

Court of Protection applications for Orders covering both financial and healthcare matters, urgent applications and acting in the administration of Deputy Orders, dealing with all reporting requirements to the Court and the Office of the Public Guardian.

Trust Creation and Administration acting for both settlors and trustees in the creation and administration of trusts including advising on the tax implications of various courses of action. Dealing with registration formalities at HM Revenue and Customs, reporting trust events and dealing with periodic charges to Inheritance Tax. Registering charitable trusts with the charity commission.

Advice on Care Home Funding and claims to the NHS for Continuing Health Care Funding, including retrospective claims.
